In Australian Capital Territory, long service leave accrues at 0.87 weeks per year of continuous service, reaching 6.0667 weeks after 7 years — the point at which the leave can actually be taken.
Payable after 5 years if the employee retires at or after minimum retiring age, resigns due to illness, incapacity or domestic or other pressing necessity, dies, or is terminated by the employer for reasons other than serious and wilful misconduct.
Leave is paid at your ordinary rate for ordinary hours — overtime and most allowances are excluded. Continuous service survives approved leave and, in most circumstances, the sale of the business to a new owner.
